Federal Public Servant and I have been diagnosed with depression and anxiety. Tried everything in the past year therapy, medications and specialists but nothing has worked for me. Sunlife is the insurance company. Waiting for a determination however really want to work just don't know if I can given the illness. If I try and go back while the determination is still pending and I fail will my claim have to be restarted? Also there is a 13 week elimination period. If I had sick leave that was more than 13 weeks and I applied closer to my sick leave expiring will I have to wait for Sunlifes benefits to kick in? I was advised by Sunlife that the 13 week elimination period was already satisfied so benefits would kick in after my sick leave expires. Is that correct?

It does depend on the wording of your policy. Most policies have a 'recurrence provision' which allows for someone to attempt to return to work, and if that doesn't go well within a certain time period, they can then go back on claim without having to start over again. You can ask your case manager for a copy of the policy to review if you have one.
