I am currently on LTD. I have been asked to return to work by my employer to a job with less pay ($25,000 per year less). I am not able to go back to my job due to my disability. Does LTD have to compensate me for the amount of money I am loosing per year by going to the new job?

Unfortunately, most LTD policies do not state that they are required to pay the difference between jobs if you're returning to work. However, your employer generally does have a duty to accommodate you to a comparable position, so this pay cut could contravene that duty. I recommend giving our employment lawyers a call at 1-855-821-5900 to discuss further to make sure your rights are being protected
