Have been going back and forth with LTD provider now for many months. Latest update is after an appeal, they have now responded to a decline for my initial injury, but have separated my second injury which occurred two years later (a re-jury actually), and have said it will be assessed separately due to a COD that came into effect in Oct ‘21. This is first time they have raised this issue even though they have known and had all the history for some time. I am concerned this is a continuation of their “stonewalling” and finding ways to manipulate the information to suit their narrative. My question is, if this second injury claim is also denied, can i take this to court with a real lawyer representing me, rather than the Union-provided rep I have now? They seem to want to push me to employer-employee grievance arbitration instead (to save time and resources I believe) even though my case they have said many times, is very strong for LTD. My issue is the grievance arbitration settlements are historically very low compared to what I would be entitled to were I to win the right to LTD and I would have to sign a release against the employer and LTD insurer were I to agree to a grievance settlement. I know usually lawyers do not want to get involved with union environment claims, but this would be after my appeals had failed and they (union) are going to walk away from Pursuing it any further. Please let me know whether or not you could represent me in the eventually that I want to pursue this LTD matter in court. Thank you
I currently receive disability benefits from an insurance company. I recently had to complete a periodic updated medical assessment and submitted all required documents. No change in my condition/status from when insurance company approved claim. Lower back injury. Then my case manager contacted my family doctor requesting (actually demanding) my entire medical file including all doctors’s notes and charts for the past year , not just for the covered injury that I am receiving disability benefits for, but all medical records. stating it is relevant to continue to assess my disability claim. My case manager also called me basically demanding I tell the doctor to forward the information. Even citing the authorization form I signed giving access to my health care providers records. The consent form actually says “can collect personal information when relevant and necessary to investigate & assess claim/administer claim & group benefits plan, etc…”. I don’t see how my entire medical file is relevant being it was not provided during the application process & the approval for the claim was made solely on the documents provided for the specific injury. Nothing has changed regarding the medical condition and all supportive documents have been provided but now the insurance company is being quite aggressive and demanding irrelevant information. My question is- I am required to provide my entire medical file to the insurance company or just records/documents relating yo the covered injury? Thank you
