I was terminated by my employer (I was a Rail Traffic Controller since 2008 for a national railway) for being on LTD and unable to give a timetable for a return. I was a unionized employee and my union is grieving this termination. I was terminated August 2, 2022 and arbitration is still pending. I submitted a complaint to the Canadian Human Rights Commission that has been paused pending the outcome of arbitration. I’m wondering if there is a legal path I can follow and if there is a deadline?

I'm sorry to hear this. Unfortunately, because you are unionized, our employment lawyers wouldn't have the jurisdiction to get involved in the matter or start a legal claim against the union. Your union representative would be able to let you know if there are any other options for you regarding this termination.
If you run into any issues with your LTD benefits, however, we may be able to assist on that front, so let us know ASAP.
