Hi, I have been on STD since late June 2023. My STD was approved for one week but after speaking with my doctor it was extended till the end of September 2023. From this extension, the insurance company said my file had to go under a medical consultant review. It took them 2 and a half months to get this complete (not the 10-14 business days they said it would). This meant I had no income for that time frame, and when I reached out to them for updates there was no care or concern over the impact this has put on my life. In a time where I was supposed to be caring for my mental health and de-stressing, I had nothing but stress! Medavie took no responsibility for the delay, and there was no concern that I couldn't pay any bills, that my utilities were cut off from non-payment - not even an apology for the inconvienience.
To top it all off - then they came back to me and said "sure you have all these symptoms, but they don't impact your ability to work". So now I've challenged their decision with further medical documentation but am now, once again, waiting.
My question is - do I have any basis for a claim against them in terms of pain and suffering? Or something similar? They have completely impacted my financial security and have no concern over it. Not to mention the bloody stress this has caused, which I am now showing physical signs of.
I am sorry for what your insurer has done to you. Unfortunately this happens quite frequently in our experience. You may have a claim for pain and suffering but it depends on the current state of your benefits and whether they are continuing to wrongly deny you benefits. Please contact us at our email or number below and we can discuss your situation and give you all your options (at no charge) so that you understand your legal rights and what can be done.
