I am returning to work on my own volition after being on Long Term Disability. The reason for the disability was due to work related anxiety and stress. Rather than having me work at my own/old bookkeeping job (Senior Bookkeeper), the company is making me learn new administrative duties and I now will be working under the supervision of two Administrators. My role as Senior Bookkeeper is still vacant. Of note, it was not the bookkeeping role that caused me hardship, but rather what was expected of me in the timeframe allotted. Can the company do this? Or should I be allowed to return to my old job?

Generally speaking, your employer should be returning you to the same or similar position. There are some caveats to that, depending on any restrictions or limitations, but I recommend speaking with one of our employment lawyers ASAP to determine your rights. You can reach them at 1-855-821-5900
