My question: Is there any law / act in BC that employer must agree to a gradual RTW schedule if medically advised and supported by Insurance company ? Background: I’ve been on LTD for past 6 months, due to a concussion sustained in ski accident (on STD previous 6 months). My Doctors and I feel I am ready to attempt to commence work and recommend a 10 week gradual return to work plan, supported by the insurance co. My employer refuses any gradual RTW plan and expect I return immediately to 40 hour work week. In an in person meeting with my employer, They advised/ threatened I should expect to be performance managed.

Generally your employer does have the duty to accommodate you in such situations. If they refuse, you may have a claim against them.
