I'm currently on permanent LTD (CPPD and LTD with my company) and I'm not expected to ever return to work. I had a workplace accident in mid Jan 2020 (not under WSIB, private insurance is covering my pay like WSIB). When I had my accident, I had 10.6 days of vacation (at 6%) owing to me and that was recently confirmed again when I reached out to payroll and HR to inquire about being paid out for my vacation. Both payroll and HR have said that I cannot get my vacation pay paid out because I'm on approved medical leave. I still receive my extended healthcare benefits through my company and that's in effect until I'm 65. I don't want to run the risk of having those benefits, so claiming "frustration" is not an ideal situation at all. I've read the Employment Standards Act with regard to vacation pay and LTD, and there doesn't seem to be any scenario that is close to addressing my situation and I can't find anything on the internet either. I'm 56 and was working full time on salary. At what point can I collect it? When my LTD is over at 65?
Generally, the outstanding vacation pay should be paid to you. You can request it from your employer, in writing, and if they refuse to provide it, please contact our employment team to discuss further at 1-855-821-5900
