I am off work on stress leave. Am I able to collect LTD if I also am an owner of a separate company? Am I allowed to attempt working to determine if I am able to return to a different job or if it is to stressful

You will likely be able to collect LTD in this situation (assuming you pass the medical test), but it does depend on the terms of your specific policy (all policies are different). You should apply right away (as there are deadlines for submitting your application). If your claim is denied for any reason, contact our firm and we will set-up a free consultation for you with an LTD lawyer, to review your options.

With regard to whether you can attempt a return to work, it depends. There are sometimes approved return to work periods, during which your insurer will continue to pay you a top-up as you attempt your return. There are also sometimes recurrent disability terms which allow you to try to work for a period of time, and if you fail within that window, you can try to revive your existing claim, as opposed to starting a new one. But again, all policies are different, so it depends on the terms of your existing policy, and returning to work always carries risks of various kinds which could negatively impact or end your LTD claim (whether lawfully or not).
