Hi, I’ve been off work and on LTD for 11 years. The LTD insurance company has paid my premiums since I was approved. My employer just terminated me for frustration of contract and is giving me severance pay, pay in lieu of notice and vacation pay. Since the LTD insurance company has paid my premiums for all these 11 years will they take all this money I’m receiving for the past years that they have paid me or offset for future payments?

I'm sorry to hear about your termination. I recommend giving our employment lawyers a call at 1-855-821-5900 to ensure you're getting what you owed.
In terms of any offsets, it is possible that the insurer will be entitled to some or all of this offest, but it would depend on the terms in your LTD policy. I recommend asking your insurer for a copy of the policy so you can review your rights. If you'd like some assistance in reviewing this, please contact our disability specialist, Rebecca, at rebecca.stap@stlawyers.ca and she can help.
