Ask your question and a Long-term Disability Lawyer in Canada will answer in minutes
I was recently let go from my job for 'frustration of contract', due to my disability. I am on LTD disability through my group benefits provider (and this will continue until age 65 in my understanding).
My question has to do with payments; my employer paid out a lump sum payment of 8 weeks in lieu of notice, plus 16 weeks severance. If I understand correctly, my LTD payments will be paused because the severance is considered income. How do I find out if the pause in LTD payments is based on gross or net severance payment? Will there ever be a time when they can legally pay me LESS than what I currently receive in LTD based on the above?
Also is there anything else I should be asking/thinking about/considering when it comes to being let go due to a disability? I am not generally looking for a fight against either my employer or my benefits provider, however I do want to ensure that I am protected overall and receive whatever I am due to receive going forward.
Thanks for your questions. Typically, any information regarding offsets will be included in your LTD policy. You can ask your case manager for a copy of this if you do not have it already. If you think they are miscalculating the offset at any time, you can ask them for a breakdown of their calculation in accordance with your policy. This often helps address the answer, but if there are still concerns, please give us a call.
If you rely on extended health benefit coverage with your employer, that may be impacted by your termination as it is a separate policy from your LTD benefits. You can ask the employer for more details.
