The insurance company asked for an independent assessment with their psychiatrist who recommended a neurocognitive testing be done with validity. Not sure but I believe this is very expensive. If I refuse because of cost will this be detrimental? if the insurance will pay for this I will do the test. The report suggests If the test comes back as showing mild cognitive impairment then a gradual return to work is mandated. The treating psychiatrist has written a report to indicate he disagrees with the report the independent psychiatrist has written and no further testing is required, and no return to work for now as healing is still in process. Can the insurance force a return to work?
The decision to return to work or not should be made between you and your doctors. The insurance company cannot force you to return to work; however, they may cut off your benefits in certain situations if you refuse to. That said, in many of those situations, their denial of benefits will be a breach of your contract/policy, so if this happens to you, please contact us right away and we'll connect you with an LTD lawyer for a free consultation to see if we can help fight it.
Regarding the neurocognitive test, it would be very strange if the insurance company is expecting you to pay for it out-of-pocket. They would typically fund such an assessment themselves, or perhaps they would be asking that your GP refer you to a specialist, which of course would be funded by OHIP. If they are in fact trying to force you to pay for this out-of-pocket, you should contact our intake team, as you may want to preemptively speak to an LTD lawyer in that situation.
