Ask your question and a Long-term Disability Lawyer in Canada will answer in minutes
My LTD with IA Financial Group was approved until March 2027. I work for the Fed Government of Canada. IA Financial Group sent a referral to an Occupational Therapist at Rehab Matters Inc. regarding a virtual assessment. This assessment is to determine if I should be participating in occupational therapy apart from what I am doing right now, which is taking prescription drugs prescribed by my family doctor, seeing my doctor monthly, seeing a psychotherapist weekly. My doctor indicates I cannot return to work right now because of my ongoing mental health issues since the passing of my husband of 41 years. My question is…do I have to agree to this virtual assessment and occupational therapy. I am doing everything IA is asking of me right now.
Typically, your insurer has the right to request that you attend an assessment or examination while on LTD. I suggest reviewing our guide on this topic to help your understanding of this - https://stlawyers.ca/disability-law/faq/ime-long-term-disability/
They may not, however, have the right to force you into specific treatment with their providers. If this happens, you can ask your case manager to show you where in your LTD policy it states they have this right. You should consult with your doctors as well.
If IA tries to threaten your benefits or pushes you into something your own health care providers don't support, please give us a call and we will help.
If you have any further questions in the meantime, you can reach out to our disability specialist Rebecca, at rebecca.permis@stlawyers.ca, at any time and she can assist (at no charge)
