I was diagnosed with severe addiction and depression. I was initially on total disability for 3 months, then residual disability the last 5 years as i've had work hour restrictions. prior to my disability i was working 80hr weeks. my current work hour restrictions from my doctor states i can only work 40-50 hrs now max. The insurance company cut off my benefits as an addiction doctor stated my addiction and depression are in remission. the addiction doctor did an abbreviated IME because the purpose of it was to remove random urine testing requirements from my licensing authority. My work hour restrictions remain. my psychiatrist states im still depressed, receiving treatment. The insurer said 1) my IME from my addiction doctor said I am in remission from addiction and depression, therefore i am no longer disabled. however my psychiatrist is clear im still depressed on treatment. the insurer also said 2) no one in my profession should work 80 hr weeks, therefore i am working full-time now at 40-50 hr weeks and there is no reason to be given residual disability benefits (despite a large income loss from my work hour restrictions, and no comment on "full-time" in my disability contract)- the contract states that the insurer will cover residual income loss based on my predicability income with no mention of hours worked. Am i still eligible for disability benefits? If i increase my work hours to 80 hrs my psychiatrist stated im at risk for worsening depression and relapse of addiction.
