Is it a common practice for an employer to send one’s request for accommodation to a third-party assessor? The company in BC is called Acclaim. I returned from a short-term disability to an accommodation of 3 days a week. With the support of my doctor, I requested the 3 days to be permanent and now my employer sent my information to a 3rd party to investigate as to, “whether or not your absence is medically supported.” I have been with this organization 19 years. In 2013 I reduced my work week to 4 days due to my chronic condition. Now as I get older, I am finding it harder to recover from a long work week and 3 days was adequate for me to keep working and not have to retire early because of my condition. I have fibromyalgia. Also, I want to point out that my employer did not get my consent to pass along my personal information to a 3rd party, they simply did it and informed me in tandem with Acclaim contacting me. They gave Acclaim my personal contact information. I am feeling rather harassed by my employer because also the Program I manage is being audited. I wondering if this is something I should be speaking to a lawyer about? Thank you kindly.

Yes, it is fairly common. However, if the employer didn’t get permission to share your personal information with a 3rd party, that could be a privacy breach. If that's the case, I recommend contacting our employment team at 1-855-821-5900 to discuss your options
