My LTD is being administered by a third party on behalf on my employer. My employer has requested from me a copy of my medical records from my treating physician. I confirmed with third party provider that they have provided medical updates to my employer. My employer has given me a final chance to provide medical documents and if i refuse they say it is a breach of my employment obligation and if I don’t they will take further action up to and including termination of my employment. Do I have to comply even though third party provider has provided medical information updates?

Generally, employers are not entitled to full copies of medical records for an employee who is on medical leave. They are often entitled to some details, such as any restrictions or potential for return to work, which generally should be provided. However, if they are asking for details regarding your diagnosis or treatment, I recommend speaking with one of our employment lawyers ASAP. You can reach us at 1-855-821-5900.
