I am on LTD and now on 12 week Gradual RTW plan. My dr created 12 week plan with accommodation of remote work. Manulife sent 12 week plan to my employer without the accommodations noting that is an employer - employee discussion .i sent a medical letter with the RTW plan & accommodations duly signed by my physician. My employer ( foreign bank) refuses to accommodate and refers to Manulife being their main provider of information. Now employer HR head wants to arrange a call with Manulife and myself to clarify. My understanding is that the employer has duty to accommodate not Manulife. Please advise since they may note that I am not in compliant with GRTW plan.
You are absolutely right - the employer does have a duty to accommodate you to the point of undue hardship. If they refuse to do so, you may have a claim available against them. Please give us a call so that we can discuss in more detail.
