Add Comment Question: Thank you for your assistance. I am on LTD (6 months now) for 3 low disk issues and a cyst pinching on my sciatic causing pain down entire leg. Been off work for 12 months healing. LTD had me on a RTW plan( before appropriate healing time was over)and required me to do intensive physio in the late fall. Knowing the risk of re-aggravating and inflaming the issue I was afraid. I followed and have had a huge setback in my recovery. At my request I had a second CT scan which has led the surgeon to requiring a MRI to determine the severity of the issue. I am continuing my walking, stretching and all other possible treatments (which have proved effective for me independently on this healing journey) Insurance would like me to start up physio again. I do not feel safe, having unguided physio without the results of the MRI. What are my rights? Am I required to follow their RTW plan for physio at this time with little knowledge and risk of further injury. Surgery may be the answer in my case. Second question, My Mother just passed suddenly (3 weeks ago) I need to go to Spain and spread her ashes. I have an opportunity to go in two weeks time in a small window where I have support. Am I able to take this trip to fulfill her wishes? I am in very poor mental health and feel this is most necessary as part of my healing. I purchased a ticket due to time sensitivity (which is refundable) taking the risk. Due to the pressure from Canada Life insurance, I am considering leaving my job and living off my small inheritance if necessary. I am afraid that if I do that, and my condition worsens then I am creating more problems and stress for myself. I am not sure how to proceed and what my options and rights are. I have a death certificate and a certificate of cremation. Thank you for taking the time to respond. (My Mother watched Disability Law every week and was most impressed by the content and advice your program offered. She could not stop promoting and had been wanting me to contact you for the last few months. She would be most relieved knowing I am now, and am hopefully finding the answers to bring the peace of mind I have been struggling to find) I look forward to hearing from you and will do anything necessary to settle this high pressure predicament. Thank you again Sincerely, Jodi Elliot Answer: I'm very sorry to hear about your loss, as well as your difficulties with your recovery. In terms of physio, you should speak with your treating physician. Let them know your hesitations and previous experience, and if they agree, have them provide the insurer with written support highlighting their recommended treatment plan. If the insurer tries to force you into anything against your own medical advice, contact us ASAP. Now, most LTD policies do have limitations on travel, however that tends to be for longer periods of time (2+ months). Typically, travelling for a week or two wouldn't impact your entitlements to benefits (especially if your doctor supports the travel). However, you can ask for a copy of your policy to see what it says regarding travel to better understand your rights.
