Add Comment Question: Hi, I am currently receiving benefits under the "any occupation" portion of my long-term disability insurance policy and am interested in learning about my potential options for returning to work. My policy includes the following language: "A Rehabilitative Program is a program: 1. of part-time or full-time work for compensation or profit while an Employee is unable, because of Illness, to be Actively At Work at his/her own regular occupation, or 2. of non-remunerative vocational training or work for the purpose of enabling the Employee to return to his/her own regular occupation or to become reasonably qualified for a Commensurate Occupation; and is approved in writing by [my insurer], in advance, as a Rehabilitative Program." Because I'm receiving benefits under the "any occupation" portion of my policy, could paragraph 1 above apply to me? Paragraph 1 mentions being at work at my "own regular occupation", which makes me wonder if this paragraph does not apply to "any occupation" beneficiaries? If paragraph 1 does not apply to me, would this mean that, as an "any occupation" recipient, I am only able to undertake the activity described in paragraph 2, i.e., non-remunerative activity, in order to continue receiving benefits? Thank you! Answer: As you suspected, if you are in the any-occ phase, typically part 1 would not apply to you. In terms of part 2, it may be possible, but you'd need to speak with your insurer about this prior to doing anything to ensure your benefits aren't jeopardize. Often, policies in the any-occ do limit earning any other income while on benefits. I would also recommend you also see if your policy has a recurrence provision. This is generally a clause that states if you attempt to RTW and are unsuccessful, you can go back on benefits within a certain time period.
