Add Comment Question: Currently on LT for a shoulder injury for which I'm waiting surgery on. Insurance is hounding me to find out if and when I can return to work. I've been employed with current employer for almost 4yrs. I have serious back problems and was denied LT in 2022 for my back because it was deemed a previous injury and I was not employed long enough, I believe 1yr requirement. Even if my shoulder recovers I know my physician will state I'm permanently disabled for my back. Will I have to start a new claim and do they have the right to deny me at this point because it was deemed an existing injury even though it has gotten considerably worse and I've been technically employed 4yrs with my company. They are constantly looking for any way out of paying me and I'm afraid to even say anything to them over the phone. Answer: I'm sorry to hear about your injuries. Generally, you will not be eligible start a new claim, unless you return to work for the required period of time to be considered an active employee. In this case, the insurer will just be looking to determine if you're disabled from working, not necessarily what the specific injury is. If your shoulder heals, but your back is still disabling, then you should still receive benefits. If they try to end them for any reason, please let us know ASAP and we will help.
