Add Comment Question: I’ve been off work since July 19/22 due to a car accident. I am currently on LT disability and my car insurance provides a top up. I’m almost at the 2 yr mark and car insurance is trying to get me to go for several assessments to see if I am able to return to any sort of job if I am unable to do required duties of my pre injury job. They now stopped my payments until I comply with the request. I was not getting by with those payments and already behind in everything so I definitely will be in trouble now. My surgeon said if I feel ready to return to work I can but I know I will not be able to do all that is required in the position I had and my employer didn’t appear interested the first time they were told I could return on modified work which is why I’m still off. Can I be forced to go back to work to a “any” that I am capable of doing even if it’s would mean having to seek a new job with a new employer for a significant pay cut. I’ve been with current employer for 20yrs Answer: If your insurer thinks that you're capable of returning to a different occupation, then they may be able to end your LTD benefits and send you back to work. However, if your doctors don't believe that you can do such work, your benefits should still continue. Additionally, your employer generally has a duty to accommodate you, so if you need modifications to be able to do your job, your employer should allow for such. If they don't, you may have a claim against them for human rights damages. If you have any further questions, please give us a call and we can help, our number is below.
