Add Comment Question: I recently submitted a claim for LTD as I have been off work due to mental illness, had inpatient treatment and on going outpatient therapy. My sick time runs out at the end of the week and I have already started my gradual return to work, but in order to get paid the hours I will not be working yet I need LTD. My physician filled out the physician statement which provides all the information you have stated should be included on your website. They asked for more medical. Which I am fine with if they have specific information they want, my dr could either write a summary note or sent a specific part of the chart. But the CM has asked for the entire chart from the day I was not able to work until current. She stated ‘if there is something you don’t want me to see, which I don’t understand why that would be, you can redact it’. I feel like this is breaching my privacy rights as shes requesting all of the information and not just the information she requires to assess the claim. Or is it reasonable to the medical information is provided in a summary note form my physician, stating each appt, impressions at appt, my functional and cognitive assessment findings during my qualifying period? The CM is claiming she cannot accept a summary note. I don’t know my rights. Answer: I would have to see your specific policy to advise you what duties it places on you. That said, you do have a duty to substantiate your disability, and practically speaking, there is a high likelihood that they would deny you if you refuse to provide seemingly relevant medical records from one of your primary doctors. If you're denied or cut-off LTD for any reason, be sure to contact us right away for a free consultation with an LTD lawyer.
