Add Comment Question: I’ve been with my employer for nearly two years and am currently on STD, and soon potentially moving to LTD . I’m considering negotiating an exit and would like to know if I’d be entitled to common law severance in this case or if severance only applies when the employer initiates termination? Based on my tenure and age, I understand I could be eligible for up to 10 months of severance—does this apply if I’m the one seeking to leave? Additionally, would severance impact my LTD benefits? Answer: Thanks for writing. You’ve actually connected to our LTD department, as opposed to our employment team – and this would really be an employment matter. I recommend using our free employment questions website (www.terminationquestions.com) as a starting point. That said, I strongly recommend that you speak with an employment lawyer before resigning or in any way terminating your employment, as that can have serious negative implications on severance, notice, vacation pay, benefits, STD/LTD, and so on - and sometimes it doesn't come with any up-side at all. If you're cut-off LTD for any reason, please contact us right away for a free consultation.
