Add Comment Question: I have worked for my company for 30 years as a field equipment installer which is a very physical job. I have been on LTD for almost 2 years because of repetitive stress injury on my knee and will require replacement at some point. The insurance company tried to force me back to work 6 months ago and I told them I would not return till there was a work place assessment done. They arranged for one and the results were that I could not return to my job due to my injuries. At this point the insurance company arranged for a vocational assessment to be done to see what kind of job I could do. After completing a 5 hour online questionnaire the insurance company told me that given my injuries and what the test results were that I was employable to answer phones at a call centre. At this point the insurance company told me I have to quit my current job and they have terminated my LTD. This does not sound right to me. According to my employer I am on leave and still an employee at this point. Is my employer responsible to take me back and find me a position that I can do with my restrictions or can they dismiss me? Answer: Your insurer should not be terminating your benefits if you still have medical support saying you're unable to work. Please contact us ASAP and we will help. Your employer generally does have a duty to accommodate you if you are able to work with restrictions, but there are some limits to this. We can help you with this as well.
