Hello,
I suffer from Complex regional pain syndrome (CRPS) is a chronic, severe pain condition that usually affects an arm or a leg, typically developing after an injury, surgery, stroke, or heart attack and Fibromyalgia.. I am already on CPPD and PWD for my disabilities.
I heard , I heard it's very DIFFICULT to be approved by the government for Disability Tax Credit and Canada Disability Benefit.
I have "invisible " conditions... But unable to work at all. If I can get approved it would help me greatly monthly for my small income.
Thank you for any guidance.

I am returning to work after 2 year disability leave. Short term, then long term within that period. My doctor completed a gradual return to work plan. My employer and insurance company created their own plan that entails a faster return to work than my doctor had ordered. I am being forced to follow this plan and have been refused an explanation as to why my employer will not accommodate my plan as written by my doctor. I was then given a schedule to return with 1 days notice, of which is non negotiable. My employer refuses to engage in any collaboration with me in my gradual return to work.
My employer changed its group LTD insurer from Insurer A to Insurer B on January

My employer changed its group LTD insurer from Insurer A to Insurer B on January 1, 2026. I was actively working when the change occurred, but in June 2026, I suddenly became unable to work. The new policy has a 12-month pre-existing condition exclusion (with 3-month look-back), and I had related medical treatment prior to the insurer change.

Does BC law or the insurance policy/ies typically provide continuity of LTD coverage in this situation, thereby making the pre-existing condition exclusion not apply to me in the usual way? If so, which insurer would be responsible for a disability that occurs shortly after the change of insurers?

If there’s no such continuity-of-coverage protection, if I return to work (full or part-time), and later become disabled again from the same condition(s), would the pre-existing condition exclusion still apply? Or could returning to work for a period of time change the analysis?
Thank you!

Canda Life states beginning July 10, 2026, the definition of disability changes and I am considered disabled if, disease or injury prevents you from being gainfully employed. Gainful employment means work: 1. you are medically able to do, 2. for which you have at least the minimum qualifications, 3. that provides income of at least 50% of your pre-disability monthly earnings; and 4. that exists either in the province or territory where you worked when the disability started or where you currently live. Your plan does not consider your location in the province or if work is available.
I am currently being treated for Circadian Rhythm Disruption and the gradual back to work plan entails a very gradual increase of work hours (4 hours starting at 1pm-5pm) (My regular work hours are 8am-4:30pm ) over a 12 week period. There would be monthly checks with the sleep clinic and main provider, noting it may take longer than 12 weeks to have my sleep adjust so that I can get to work for 8 am.
I had notified Canada Life of intent to appeal before the cutoff date but would like to know if there is actually a chance to extend the claim (while I am still in treatment to extend my working hours), what are the chances of winning an appeal for my situation?

I have been approved for LTD disability benefits back in June. They have requested an update from my doctor in addition to my full chart. I have sent them the updated assessment however my doctor is currently not sending the chart as he wants more payment because it's all paper based. He says it needs to be copied and he's requesting more payment for that. I keep letting my doctor know about the requests from my insurance company and my insurance company keeps requesting the information they want and my doctor keeps requesting more money. He said he faxed them and then indicated on the assessment that he was requesting more funds. But my insurance company and my doctor won't talk to each other directly they just keep advising what they want to each other and me without actually discussing any of it. I don't want this to impact my continued approval for benefits. Do you have any advice for me?

My LTD has been extended past the two year mark for about 6 weeks. Canada Life has

My LTD has been extended past the two year mark for about 6 weeks. Canada Life has presented a gradual back to work plan and I have gone into work for two four hour days 1pm-5pm so far (week 1 of the plan). This was discussed with the Canada Life OT where it was assumed that the start time would be towards the end of the day (unfortunately I did not get that in writing from her). I have a letter from my psychiatrist with limitations and accommodations. I am currently seeing a sleep clinic to address sleep-wake schedule dysregulation.

In the letter under current restrictions and limitations is stated "Her current wake time is approximately 11:00 AM. She is not yet able to reliably wake by6:00 AM, which would be required for an 8:00 AM start."

In the letter under recommended accommodations for return to work is stated " Modified start time: A start time no earlier than 11:00 AM initially, with a planned gradual advancement in alignment with sleep clinic recommendations"

When I discussed this item with my psychiatrist, it was under the assumption I'd be able to work from home a couple of days a week.

Issue 1: My employer sent an email at the end of the day Friday stating they are expecting me to come into the office (no working from home during the return to work plan) for 11am (today). (job hours 8 am to 4:30 were stated in that email from work and were provided to Canada Life). I sent an email stating that "that the expectations go against my active medical limitations and thus cannot be performed safely and would not be coming in" and I would be speaking with Canada Life this afternoon.

Question: What action can I take to ensure that the restrictions and limitations are adhered to and I don't have this 'demand' from work making me look bad that I can't fulfill?

Issue 2: I have not been into work since those first couple days, as Canada Life was to address work's request to start at 11am (as you can see it was not resolved), so work has decided to not continue the gradual back to work plan weeks but to skip ahead to week 3 disregarding the gradual addition of days and hours that was approved by my providers and the plan created by Canada Life OT.

Question: What action can I take to ensure that the gradual back to work plan is continued from week 2?

I have

I'm currently on long term disability. However, I'm very concerned that I will not be able to return to my role due to memory issues and my role isn't probably the best fit for me anymore. I asked for a modification to my role and due to system linguistics it's not possible I've been told by my employer.
I have an uncommon situation that’s left me unsure how to position my CPPD application,

I have an uncommon situation that’s left me unsure how to position my CPPD application, particularly in terms of meeting the MQP requirement. Background: I became legally blind in 2010. At the time I was living and working in Canada, contributing to CPPD with each paycheque as most people do. In 2012 I moved to Switzerland, were I worked for an international organization. Although Switzerland has a tax treaty with Canada, my salary was exempt from taxes as I was working for a UN agency, so I did not pay into the Swiss equivalent of CPPD, and do not have CPPD credits for the time I spent there. As my sight continued to deteriorate, I returned to Canada in 2023 as a workplace accommodation. So while I was living in Canada then, my salary was still tax exempt. I voluntarily contributed to CPP for the 2023 and 2024 tax years using the CPT20 form. In 2025, I went on sick leave with my work. I have not yet filed my 2025 taxes or contributed to CPP for that year. In July 2026 my sick leave will end, and I will formally separate from employment. The income I’ve received in 2025 and 2026 is also tax exempt, meaning I can only elect to pay into CPP at the earliest, when I file my taxes. So I believe I now have a few different options in applying for CPPD. *** Option 1: Date of symptom onset was in 2010. If Service Canada uses 2010 as my effective date of disability, MQP should not be a problem, as I contributed each year for over a decade before reaching legal blindness. I suspect it may be a challenge to justify how I kept working for 15+ years after that date, although I do have a long history of incremental accommodations and use of assistive technology documented. *** Option 2: The date of symptom onset was 2026. While I went on sick leave in 2025, that was the point I could not do the job I had. Working with my doctor, I feel I could make the case that the date of symptom onset is 2026, as II no longer have capacity to do work of any sort. The problem with this approach, is the delay in electing to pay into CPP. Because my contributions come only when my taxes are filed, I could not apply for CPPD until 2027 (as I have only contributed for 2023 and 2024 so far. I can contribute for 2025 once I file my taxes). My question: Which approach is most likely to be successful? If I were to make an initial application with option 1 and be rejected, could I file an appeal then asking Service Canada to consider option 2? What else do I need to consider? I am guessing that appeals usually focus on medical documentation, rather than asking for Service Canada to use a different effective date of disability. I would be very grateful for your guidance and experience on issues like this. Thank you!

I am on ltd for six + years. I just got accepted by CPP disability. My insurance will continue to pay me but deduct the cpp amount from my monthly payment. If I was to retire from my workplace (to which I qualify now) the cpp payment would not affect my pension payment. So that would mean that I would have that extra money monthly. Should I cancel ( and how to do-that) my ltd claim and just retire. I am 58 years old. Manulife would most likely pay me until I am 65. Also could I get a cash out from Manulife if I opt out of the ltd before age 65.

Hi, I am on LTD and received approval for CPPD. The insurer is calculating the gross offset vs. net. However although my policy wording distinguishes between gross and net earnings in certain sections of the LTD provisions, it does not have wording that specifically states CPP disability offsets are calculated using gross amounts before tax deductions. My insurer acknowledges that the policy does not specifically state that CPPD offsets are calculated using gross amounts and that the interpretation being applied is based on industry standard practice. Can they do this? If policy is ambiguous (doesn’t specify gross or net under offsets but clearly specify that in other sections) and this is a taxable benefit that means they are deducting more than what I will actually take home.

I was on a GRTW plan, but it was a fail. I stopped working before it was completed. Sent an email to my employer and my physician sent a summary letter to Manulife. Manulife asked for medical documentation to review. My physician faxed medical clinical notes to Manulife . Note this process was also done when I applied for LTD and approved in January 2026. Adjuster has now said that clinical notes are illegible. My physician sent a short summary and the clinical notes again by fax and an email noting that this was similar process that was done in January . Same claims adjuster . Needless to say, my physician doesn’t have the time or staff to create new notes. This does not sound appropriate. Can you provide any insight?

Federal Employee - Sunlife Benefits - Investigation - I learned a few weeks ago that I was under investigation/review. They asked for documents, which I provided. Since then, they have not issued a new decision, but they won't answer my questions. I asked, "What is the status of my claim?" , they haven't provided an answer. I am also not getting any information about how long my file will be under review, how long before they issue a decision about something, what's at risk. I asked, but they ignored my question. Literally, they acknowledge receiving the email and voicemail, said they will look at my document, that my benefits for last month was "released" (from what... I don't know). They are keeping me in the dark. Is this legal? Also, what are the normal processing times for a review once they have all the documents? What is considered reasonable? Can they really keep me in a state of "terror" about my benefits for weeks without providing information? What are my recourse while waiting? Please note that to my knowledge, last decision on file is approval until 2027.

I urgently need to ask just 1 question. I’m willing to pay for the Disability Lawyer’s time—Please tell me how to pay.

My question is about how to answer the question “Are you receiving any other income?” My Sun Life (SL) insurance policy mentions a definition regarding “rate of earned income.” The LTD provision mentions deducting “disability income or retirement income from other sources” from the monthly LTD payment. However, I can’t find any definition of “income” or “any other income” either in the definitions section or in the LTD provision of the SL contract.

When SL used to send a yearly paper form, it had a section called “Confirmation of all other income you are currently receiving” & a sub-section under that called “Any other income (e.g., from other insurance companies, legal action, etc.).” I always checked off the box for “No” because I understood that my Inherited Assets were Assets (& not income). The instructions given to the financial institution were to grow the Inherited Assets without causing too many expenses & I’ve never taken any money out to use as income. Unfortunately, another relative died, so I will be having another (small) inheritance. It didn’t even occur to me (until now) to consider the insignificant nominal bit of interest on my bank accounts—a total of less than $20 last year for all of my bank accounts put together.

SL sent me an electronic yearly update form (administered by The Claim Lab). This electronic update form asks the question: “Are you receiving any other income?” I have been answering “No,” as I used to answer on the paper form, for the same reasons as I gave for answering “No” on the paper form.

Because Tax time is coming, my mind is occupied with locating papers to take to the Tax preparer. Now I’m starting to worry that maybe I should be including the information from my Inherited Assets’ Tax slips—even though I’ve never taken any of the money out to use as income.

Please tell me if I should answer “Yes” to the electronic question “Are you receiving any other income?”

If I should change my answer to “Yes,” should I send some type of explanation to SL? Would it help to hire a Lawyer to write something for me? OR is that something that should wait until such time as SL contacts me?

Thanks very much for helping me with my question about “any other income.”

This is my second question on the same topic but more in depth.

I went on STD

This is my second question on the same topic but more in depth.

I went on STD on April 17, 2024 due end stage arthritis and could not handle the pain anymore as I work on a large printing press that is 4 stories high and a major part of my jump involves climbing the stairs multiple times per shift and walking and standing on concrete floors.

I transitioned to LTD on August 9 2024, and my 2 year change of definition is coming up soon. I had right ankle fusion surgery on June 25, 2025 and just recently had a ct scan showing that my fusion healed less then 25% and a second surgery is required. My surgeon gave me 2 options, have revision surgery which is risky and complicated and hope it works this time or live with the pain forever. Before I made my decision, I let Desjardins know my situation and told them I had 2 options. I asked them what my options are on whether I decide to do the surgery or not and they said if I do the surgery, my benefits " should" continue past the change of definition date and if I don't do the surgery, my benefits will be cut off. So basically I do not have a choice in the matter. I told Desjardins that I waited 1 1/2 years for the firt surgery and would my benefits continue after my change of definition date of August . They said no, my benefits would stop and I would have to find gainful employment until I get a surgery date. I called my surgeon and asked when is the soonest that I can have surgery. I am booked for surgery on June 23, 2026. With all that said, for me to find gainful employment, Desjardins contract says the job must be a suitable job for me, based on training, knowledge and education and it must pay 66.67% of my wage prior to me going on disability and my wage is $51.16 per hour and 66.67% of that is $34.11 per hour. The last grade I passed was grade 8, I tried starting grade 10 4 times but dropped out every time. I have no education, the only experience I have is running a press and I have no training , I started my job at age 19 and I am now 51, I have been at my job for 32 years and I only know printing which is a dying trade. How can they make me find gainful employment at A minimum of $34.11 per hour with my lack of education and training. Can they cut my benefits off of would they have to pay me my benefits until I am 65?

I am currently on an unpaid leave due to illness. My last day worked was September 22, 2025. I was on short term disability which ended January 20, 2026. My LTD claim was rejected as I had been employed by the company a few days short of one year and it was determined to be a preexisting condition. My employer is telling me I’m required to comply with a third party adjudication process to determine whether or not my unpaid leave is supported. The third party company is requiring me to give them full and unlimited access to my medical records, and have a form filled out by my treating practitioner that discloses my diagnosis, symptoms, medications and doses, if I go to therapy, and my PHQ-9 and GAD-7 scores. I want to know if I am legally obligated to provide this information even though it is not noted on my hiring contract or the employee handbook.
My LTD with IA Financial Group was approved until March 2027. I work for the Fed Government of Canada. IA Financial Group sent a referral to an Occupational Therapist at Rehab Matters Inc. regarding a virtual assessment. This assessment is to determine if I should be participating in occupational therapy apart from what I am doing right now, which is taking prescription drugs prescribed by my family doctor, seeing my doctor monthly, seeing a psychotherapist weekly. My doctor indicates I cannot return to work right now because of my ongoing mental health issues since the passing of my husband of 41 years. My question is…do I have to agree to this virtual assessment and occupational therapy. I am doing everything IA is asking of me right now.

I have been on LTD since Jan 1 of this year. I am receiving 50% of my previous income

I have been on LTD since Jan 1 of this year. I am receiving 50% of my previous income and the policy states I can make 85% of my previous income before the benefit payment gets clawed back. The insurer made me claim vacation pay which was accrued from July 01 2024 until Dec 31 2025 because it wasn't paid until the first week of 2026. So obviously 1 month of benefit payment was almost completely clawed back. Seems very unfair. Why are they allowed to do this?
Also, they have informed me any RRSP withdrawals must be reported as well. Why are insurers allowed to count RRSP withdrawals as regular income?

Thanks, Steve

am seeking legal advice regarding a workplace accommodation issue in Ontario involving

am seeking legal advice regarding a workplace accommodation issue in Ontario involving medical leave, disability benefits, and potential termination risk.

I work in a customer service role that involves high-volume phone interactions. I went on medical leave due to Major Depressive Disorder with anxiety features. My treating physician and therapist have both provided written documentation stating that returning to full phone-based duties at this stage risks relapse and recommending modified duties or gradual exposure.

I received disability benefits for a period of 6 months, but my insurer has now denied continued modified duties on the basis that I do not meet their contractual definition of disability. As a result, my benefits have ended.
My employer has indicated that phone work is considered an essential duty of my position. While temporary accommodations were provided, I am now concerned that I may be required to return to full phone duties despite medical recommendations to the contrary.
I am worried about the risk of termination if I am unable to perform phone-based duties and would like clarification on my rights and my employer’s obligations.
1. The scope of my employer’s duty to accommodate under the Ontario Human Rights Code.
2. Whether an employer can terminate employment if medical documentation supports restrictions on essential duties.
3. Whether an insurer’s denial affects the employer’s accommodation obligations.
4. What may constitute “undue hardship” in this context.
5. My potential entitlements if termination occurs.
6. Whether appealing the disability denial would be advisable.
I am trying to protect my employment rights while managing a documented medical condition.
Thank you for your time.

Federal Public Servant and I have been diagnosed with depression and anxiety. Tried everything in the past year therapy, medications and specialists but nothing has worked for me. Sunlife is the insurance company. Waiting for a determination however really want to work just don't know if I can given the illness. If I try and go back while the determination is still pending and I fail will my claim have to be restarted? Also there is a 13 week elimination period. If I had sick leave that was more than 13 weeks and I applied closer to my sick leave expiring will I have to wait for Sunlifes benefits to kick in? I was advised by Sunlife that the 13 week elimination period was already satisfied so benefits would kick in after my sick leave expires. Is that correct?

Hello,
I have been on Medavie-Blue cross LTD (through my employer) since 2023. I had shingles and it left me with Trigeminal nerve pain/damage in my forehead, scalp and eye. However, back in 1989 I had signed a disability policy with Confederation Life, which is now under Manulife, and it was for the amount of $2000 per month. I didn't put in a claim, as I understood I could only go through one company and Medaview-Blue Cross was for 66.7% of my wage so I disregarded the private policy. After all these years I was going to cancel my Confederation/Manulife policy but realized, (after reading my handbook), that I may be able to make a claim to Manulife, as Medavie-Blue cross does not include private disability policy's in their Integration of Benefits , direct offset plan-Income from all other sources. Can you confirm that "income from all other sources" excludes private policies?
Shall I go ahead and make a claim for my private Confederation/Manulife policy?
And would I still be eligible as my disability is from 2023?
Would making a claim cause my Medavie-Blue Cross coverage to be disrupted or cut off?
Should I inform Medavie-Blue cross of this finding? I was not intending to mislead either company, I just did not understand the policies.
Thank you

I recieved the following letter (I only had room to paste part of the letter) I am wondering if this is something I should further investigate or is it my legal requirement or best practice? ... We would like to provide you with information about the advantages and processes related to applying for CPP (Canada Pension Plan) benefits and how it may impact your monthly benefits from Manulife. Advantages for Applying to CPP: CPP considers the time CPP Disability benefits were received when calculating the CPP Retirement benefit. This ensures that you are not penalized for the time you are not working and not contributing to CPP, potentially resulting in higher CPP Retirement benefits at age 65 if you received CPP Disability benefits before that age. CPP provides a cost-of-living allowance (COLA) each January, leading to an annual increase in the CPP benefit based on the COLA. Additional CPP benefits may be available if you have dependents under 18. Specific forms related to this benefit will be sent to you, requiring the dates of birth of each dependent. Application Process: CPP benefit claims are processed by Service Canada and may take 6 months or longer to render a decision. Manulife will continue to pay disability benefits as usual while you wait for the decision on CPP disability benefits. How CPP benefits impact your monthly benefit from Manulife: There is no impact to your Manulife disability claim if your CPP claim is declined. However, when approved, the CPP benefit will impact your Manulife payment. If approved, CPP benefits are paid monthly. We deduct the CPP/QPP benefit amount dollar for dollar from the LTD benefit. The Manulife monthly benefit is reduced so our payment PLUS the CPP payment is equal to what you received from Manulife prior to CPP approval. CPP Benefits are taxable, therefore the total monthly amount received from CPP and LTD may be slightly lower because of the tax deducted from CPP, However, when you do your tax return, you may get the amount taxed from CPP refunded. CPP may determine that you are entitled to benefits before you applied, resulting in a potential retroactive approval and lump sum payment. It's important to notify Manulife immediately about any retroactive payments received from CPP. How CPP Dependent benefits impact your monthly benefit from Manulife: Your group policy allows you to receive up to 85% of your net pre-disability earnings from all sources of income while you receive LTD benefits. In your case, the amount is $4553.41. This is the All-Source Maximum and is considered when you receive benefits from other sources. Any amount over this maximum percent (ASM) is reduced from the benefit we pay

My Ltd benefit states “lifetime” is this my normal human lifetime? Or is there an age cutoff like at 65?

My injury was outside of workplace, I fell in a shopping mall (baby oil was spilt intentionally by teenagers in the morning, and wet floor signs were placed out next to the ‘wet’ mess however as it was five feet in front of an exit/ entrance there was a lot of tracks spreading this oil on the floor passed the wet sign barriers. This intentional spill was at two store interior doors and three other entrance / exit doors. I fell and have been off work for over a year now with a head injury. My doctor is supportive and has ordered tests. At this time my insurance has been supportive as they approved me until August 2026. My employer keeps requesting documents and when sent they state they are reviewing the requested leave extension(s) to date they’ve also been supportive.

However what happens if my employer decides they won’t have me back? Can they do that? My friends said to collect ei but can I ? When I’m collecting insurance monthly payments? I have consumer debt that has built beyond my means , I’m struggling to complete the paperwork for these insurance companies. I reached out to a local lawyer last year but other than accepting updated paperwork by his receptionist, he only says I have a difficult case. I’m stunned and normally I am competent, intelligent and highly skilled, however the last year I have had many many struggles. My doctor has me on three prescriptions and I’m not sure they are helping but I’m scared to ask to stop taking them as I don’t want to be deemed someone not participating in their recovery. I’m just fuddling through the best I can but I feel very insecure and scared about the future

I am a 62 year old unionized delivery driver who has been off work for over two years

I am a 62 year old unionized delivery driver who has been off work for over two years on short and long term disability due to a back problem. Our insurance provider is Desjardins. After numerous treatments which have had little effect it has been determined that I cannot return to my previous job. My employer will not offer any alternative work. Desjardins had me do a transferable skills analysis which determined that there were a couple of sedentary jobs that I could be eligible for with some additional training( such as Word or Excel ) and that I would be cut off from receiving benefits at the end of October 2026, close to my 63rd birthday. This seems to me to be clearly just a means to get me off their books. If I did what they suggest, any prospective employer would have to accommodate my significant physical limitations, would have to accept my barest of minimal qualifications, my complete lack of experience, my need for significant on the job training, the fact that I would only work there for at most two years and would have to pay me above entry level pay for the position. This all seems beyond unlikely to me.
I do not have enough knowledge or experience on the subject to even know what my rights and responsibilities are in this situation. I am not willing to simply accept Desjardins ruling on the matter. would this be something your office could offer some advice and information on?
