Hello, I have been on LTDI through OTIP for 6 years without any hope of going back to work. I am only being compensated for being a part time teacher as I was on sick leave for half the work day at the time of my claim. Is there anyway I can appeal this? I was not mentally competent at the time of my application and I always have assumed I could go back to work.

You should review the wording of your disability policy to determine how the insurance company determines your monthly payments as the insurer must follow what is written in your policy. Generally we are unable to fight the benefit calculation if they have followed the policy obligations. If you have further questions about interpreting your policy or run into any issues with your insurer, please contact me at rebecca.stap@stlawyers.ca or 1-844-661-9065 x132.
