I was on long term disability for one year and returned to work. After 3 months had to go back on medical leave and was initially diagnosed with anxiety. I was denied STD because I was told it was the same as what I was diagnosed before. No pay for three months and am stressed out.
I was referred to a psychiatrist that diagnosed me with PTSD last month. The note was sent to the insurance and they denied me any disability support and gave me the option to appeal.
My boss is now texting me when I am returning as I am not on LTD. Is she allowed to do that?
I sent a note from my doctor stating I am unable to work - will that protect my job or can they let me go?
I am so stressed with no money and my boss and insurance not understanding my situation. What next steps should I take?
I'm sorry to hear what you're going through. I suggest that you reach out to our office directly to chat about your STD denial as we may be able to assist.
In terms of your employment, as long as your doctor has provided the note saying that you're off for medical reasons, they should be respectful of that. I recommend reviewing our FAQ guide on communicating with your employers while on leave -https://stlawyers.ca/disability-law/faq/communicating-employer-on-ltd/
If you have further questions or concerns, or want to discuss this in more detail, please give us a call and we'll help.
