Long Question.. My daughter has epilepsy (diagnosed 2021) and it is uncontrolled. She works for a mental health hospital. She has been off for periods of time. Currently she has the ok from her family doctor, neurologist and her neurologist that only specializes in epilepsy to return to work but her employer and employers insurance company is not allowing her to. She is unionized and has been told she can't have a lawyer only her union or she could get fired "there is a process" She is currently getting ltd payments thru her employer/insurance company. Is any of this legal? She seems to believe everything they say but I am afraid they are tricking her. Not sure what to fo
Thanks for writing. Your daughter's employer refusing to let her try to return to work is really an employment question, rather than an LTD question.
I would typically redirect you to our free employment questions website (www.terminationquestions.com) as a starting point, but because you're in a union, I don't believe they would be able to assist you, unfortunately.
That said, if she's ever cut-off LTD (hopefully not), let us know and we'll connect you with an LTD lawyer for a free consultation right away.
